Thank you for trusting Jenjang products. By subscribing to Jenjang products, you acknowledge and agree that you have carefully read, accepted, and understood all applicable Terms and Conditions.
Introduction
Definitions
- Jenjang - PT. Jenjang Talenta Indonesia is a limited liability company established under the laws of the Republic of Indonesia that owns the brand and/or products hereinafter referred to as "Jenjang Products" available at Jenjang.com.
- CUSTOMER or You is a legal entity or Individual who has agreed to subscribe to Jenjang products and agrees to these T&C.
- Account is a platform within the Jenjang application used by CUSTOMERS to access and use Jenjang products.
- Fee is the nominal fee that must be paid by the Customer to us for the use of Jenjang products.
- Personal Data is any information in any form that CUSTOMERS provide to Jenjang and any data relating to individuals including but not limited to name, ID number, address and other information.
- We are Jenjang - PT. Jenjang Talenta Indonesia which provides Jenjang products.
- Jenjang Products are all Jenjang services consisting of several packages provided for CUSTOMERS.
- Term is the active period of CUSTOMER using Jenjang products starting from the activation of the account, this period can be extended automatically unless one Party intends to terminate the Service as evidenced by the termination minutes in the account.
- Disruption is anything that causes the use of Jenjang products to not function as intended.
- Terms and Conditions or T&C are rules governing CUSTOMERS using Jenjang products.
General Policy
Scope
- Jenjang will provide several products that can be used by CUSTOMERS with package details as available at Jenjang.com.
- CUSTOMER agrees to use Jenjang products in accordance with these T&C and the use of products is entirely the responsibility of the CUSTOMER.
- By subscribing to Jenjang products, CUSTOMER declares to agree to these T&C, CUSTOMER is subject to and legally bound by the T&C available at Jenjang.com and/or changes that may be changed from time to time by Jenjang.
Product Terms
- CUSTOMER acknowledges, understands, and agrees that the Jenjang product package selected through Jenjang.com is in accordance with their needs and agrees to each applicable provision in each product package.
- CUSTOMER must comply with these T&C, and other provisions that may apply in the future including but not limited to usage methods, payment terms, subscription fees and other technical provisions.
Customer Rights
- The right to receive Jenjang Services 24 (twenty-four) hours a day, 7 (seven) days a week during the subscription period.
- The right to receive information about T&C set by Jenjang for the use of Jenjang products.
- The right to receive Service Level Guarantee for the use of Jenjang products in accordance with the T&C set by Jenjang.
- The right to file a claim if there is an error in the bill that can be submitted no later than 30 (thirty) calendar days from the date the bill is issued.
Customer Responsibilities
- Use Jenjang products as intended in accordance with these T&C and other provisions set by Jenjang - PT. Jenjang Talenta Indonesia.
- CUSTOMER is fully responsible for all use of Jenjang products by anyone at the CUSTOMER's address or account, and releases Jenjang from liability for the consequences of using such products.
- CUSTOMER must comply with applicable laws and regulations in Indonesia regarding the use or utilization of Jenjang products.
- CUSTOMER has payment responsibility for fees arising from the use of Jenjang products according to the agreed product package.
- CUSTOMER gives consent to Jenjang to process CUSTOMER's Personal Data provided limited to the implementation of the use of Jenjang products.
Prohibitions for Customers
CUSTOMERS are prohibited from using Jenjang products to do anything that may harm any party, including but not limited to:
- Disrupting or damaging data or computer systems of any party.
- Sending emails continuously and irresponsibly (spamming).
- Falsifying email headers or other methods to falsify CUSTOMER identity.
- Violating Intellectual Property Rights (IPR) of others.
- Committing extortion and/or threatening or intimidating directed at individuals and the public.
- Spreading false and misleading news that results in consumer losses in electronic transactions.
- Spreading certain information intended to generate hatred or hostility from individuals and/or certain groups based on ethnicity, religion, race, and inter-group (SARA).
- Accessing computers and/or electronic systems of others in any way by violating, infiltrating, or destroying security systems to obtain electronic information and/or electronic documents.
- Intercepting electronic information and/or electronic documents on computers and/or certain electronic documents belonging to others, except those carried out in the context of law enforcement at the request of the police, prosecutor's office and/or other law enforcement agencies established by law.
- And other actions that violate norms of politeness, decency rules, or applicable laws in the territory of the Republic of Indonesia.
Rights of Jenjang - PT. Jenjang Talenta Indonesia
- Receive subscription fee payments from CUSTOMERS on time according to bills sent by Jenjang.
- Change Jenjang products including but not limited to prices, facilities of each product, product types and these T&C aimed at increasing added value, reliability and security for CUSTOMERS.
- Reject requests from CUSTOMERS if the request does not meet the technical requirements of Jenjang - PT. Jenjang Talenta Indonesia.
- Inspect and manage Jenjang products received by CUSTOMERS to ensure that services function properly.
- Manage hardware installed to support Jenjang product services owned by Jenjang - PT. Jenjang Talenta Indonesia.
Responsibilities of Jenjang - PT. Jenjang Talenta Indonesia
- Use personal data provided by CUSTOMERS intended for the implementation of these T&C as long as CUSTOMERS use Jenjang products.
- Provide good and transparent services related to Jenjang products to CUSTOMERS.
- Provide information about the quality and general characteristics of Jenjang products provided by Jenjang - PT. Jenjang Talenta Indonesia through the Jenjang.com website, brochures, leaflets or other media.
- Provide Service Level Guarantee for the use of Jenjang products in accordance with Jenjang - PT. Jenjang Talenta Indonesia provisions.
- Follow up on CUSTOMER reports if there are problems when using Jenjang products.
- Follow up on CUSTOMER requests to unsubscribe from Jenjang products.
Limitation of Jenjang's Liability
- Jenjang under any circumstances is not responsible for any claims from any party including regarding losses experienced by CUSTOMERS or losses of other parties that occur such as:
- Lost data
- Loss of income, profit, or other earnings.
- Loss, damage, or injury caused by anything related to the use of services.
Violations and Penalties
- Violations of these T&C will be subject to penalties in the form of termination/revocation of Jenjang Services in accordance with the provisions of Jenjang - PT. Jenjang Talenta Indonesia.
- In addition to the penalty in number (1), violations of these T&C will be subject to penalties according to provisions that will be further determined by Jenjang - PT. Jenjang Talenta Indonesia as the provider.
Force Majeure
- If the Parties cannot carry out part or all of these T&C caused by Force Majeure and have notified the other Party in these T&C, it cannot be categorized as a Violation.
- Force Majeure is any event that with power and effort cannot be predicted and cannot be overcome by the Party experiencing it, including but not limited to fire, earthquake, Government policy, riots or other crimes, and other causes beyond control that cause the Parties or one Party to be unable to fulfill their obligations.
- All losses and costs resulting from the Force Majeure are the responsibility of each Party and the unaffected Party cannot file a lawsuit and request compensation.
- The Party experiencing Force Majeure will do their best to restore their condition in the shortest possible time and always notify the other Party about the plans they will take to anticipate and reduce the consequences of the Force Majeure.
Termination of Contract/Jenjang Services
- These Terms and Conditions apply as long as CUSTOMER subscribes to Jenjang products.
- Based on our understanding, decision and/or consideration we find or suspect the following actions: fraud, indication of criminal acts, criminal acts and/or violations of applicable legal provisions.
- CUSTOMER violates the provisions as regulated in these terms and conditions.
- Some or all of the data provided by CUSTOMER is incorrect, incomplete, false, fabricated and/or misleading.
- CUSTOMER passes away.
- The company, business entity, legal entity or civil partnership you represent is dissolved and liquidated either based on its own will or based on a court and/or government decision.
- One of the Parties is declared bankrupt or there is a postponement of debt payment obligations that affects the implementation of these T&C.
- Jenjang can unilaterally terminate services because CUSTOMER does not make subscription fee payments or Jenjang can no longer be a Jenjang Service provider for CUSTOMERS due to technical constraints.
- The subscription period has ended, Jenjang can terminate services but does not eliminate the CUSTOMER's obligation to pay all unpaid service bills.
- CUSTOMER intends to change Jenjang Services (either Upgrade or Downgrade), then the provisions for the use of the old product no longer apply.
- Jenjang and CUSTOMER have agreed to waive the provisions of articles 1266 and 1267 of the Civil Code, so that cancellation or termination of the subscription contract can be done by either party in case of default and declared valid without going through a court process.
Intellectual Property
- These Terms and Conditions do not contain any statement stating as a transfer or transfer of any Intellectual Property Rights that belong to each Party or its affiliates under applicable laws and regulations.
- All layouts, designs, and appearances of the Jenjang.com website and not limited to logos, images, names, brands, words, letters, numbers, writings, and color arrangements on the website and combinations of the elements mentioned above are Intellectual Property Rights owned by Jenjang - PT. Jenjang Talenta Indonesia and no other party is entitled to them.
- You are prohibited in any way and under any conditions from using our Intellectual Property as mentioned in number (2) above without prior written consent from Jenjang - PT. Jenjang Talenta Indonesia.
Applicable Law and Dispute Resolution
- These Terms and Conditions are governed and interpreted under the laws of the Republic of Indonesia.
- Any dispute arising in connection with or related to matters regulated in these Terms and Conditions, including disputes caused by illegal actions or violations of one or more of these Terms and Conditions ("Dispute") agree to be resolved through deliberation to reach consensus. If within 60 working days after the Dispute arises that cannot be resolved through deliberation to reach consensus, then you and we agree to resolve the Dispute through the Registrar's Office of the Yogyakarta District Court.
- Unless required by applicable law or official request submitted, decisions published or made by courts or authorized government agencies during the Dispute resolution process as regulated above, you are obliged to keep all confidential information including the resolution process until there is a valid, final, and binding resolution between you and Jenjang. Therefore, you are restricted in any way from notifying or announcing to any party regarding the Dispute and its resolution process including but not limited to mass media (newspapers, television, internet, social media, and/or any other media). If you violate this provision, then you agree that all or part of your rights to use Jenjang Services may be isolated or revoked by us either temporarily or permanently
Service Policy
Below are the T&C of services that will be provided by Jenjang.com to Customers:
This platform combines psychological insights, advanced digital technology, and strategic approaches to offer complete solutions such as self-development, Human Resource Management (HRM), and organizational management.
This platform provides three types of registration that can be customized to your needs:
- Jenjang for Personal: Suitable for individuals who want to use this application according to their personal needs.
- Jenjang for Schools: Can be used by schools to support educational needs by registering schools and adding students.
- Jenjang for Business: Designed for companies that want to meet their business needs by registering companies and adding talents.
Downtime and Restitution Policy
Downtime mentioned in this service commitment does not apply to:
- Downtime due to scheduled maintenance activities that have been informed to customers.
- Failure to create/purchase new services.
- Downtime as a result of actions by customers or other third parties caused by customer ignorance in using Jenjang.com services.
- Downtime as a result of customers not taking actions recommended by Jenjang.com.
- Intermittent downtime that occurs in a short time.
- Downtime on the Jenjang.com site or portal that does not impact customer services.
- Force Majeure beyond the control of Jenjang.com. Force Majeure may include (but is not limited to) fire, flood, earthquake, war, terrorism, criminal activity, riots, explosions, sabotage, embargo, natural disasters, strikes, government policies, changes in law or investment policies in Indonesia.
- Downtime as a result of equipment, software, or other technology owned by customers or third parties outside equipment under direct control of Jenjang.com.
- Other disruptions not caused by Jenjang.com's fault.
Service Termination
Jenjang.com may suspend Service performance and/or terminate Services if Customer:
- Commits a violation of T&C material, the nature of which cannot be remedied;
- Violates material provisions of these T&C, which violations can be remedied (including failure to pay bills to Jenjang.com), and if the violating Customer has not remedied the violation within 7 (seven) days of notification from Jenjang.com;
- Bankrupt, ceases to conduct business as a going concern, is unable to pay debts when due, or becomes the subject of voluntary or involuntary institution of bankruptcy or liquidation proceedings;
- In these service termination T&C, Customer agrees to waive the provisions of Article 1266 of the Indonesian Civil Code. Upon expiration or termination of these T&C for any reason, Customer's right to use the Services, and any other rights granted to Customer under this Agreement, immediately terminate. All fees for Services provided to Customer will be due and payable upon receipt of the final invoice.
Disclaimers
Jenjang.com under any circumstances does not promise that its services will be uninterrupted, error-free, or completely secure and implied warranties regarding merchantability or satisfactory quality, fitness for a particular purpose and no infringement of any third party intellectual property rights.
All services are provided or performed on an "as is", "as available" basis, and use of services by customers is solely at their own risk.
The above disclaimer applies to any damage, liability or injury caused by performance failure, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access, alteration, or use, whether for breach of contract, error, negligence or other cause of action.
Jenjang.com reserves the right to do the following, at any time, without notice: (1) modify, suspend, or discontinue access to services; (2) discontinue operation of services, or any part of services, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Payment Policy
Payment and Fee Policy
- Service fee payments are made through the payment methods provided. After successful payment you will receive a receipt automatically from the Jenjang.com system. Please ensure payment proof is downloaded and stored in a safe place for future reference.
- Jenjang.com will provide services or service extensions provided that full payment has been received. Jenjang.com will notify regarding the due date via Jenjang.com email.
- Payments made can be used to pay for Jenjang.com services up to monthly and/or annually.
- Payments that have been processed cannot be returned or refunded.
- Jenjang.com services will be SUSPENDED on D+1 after Payment is not made.
- Fifteen days after suspension if there is no notification (ticket) we reserve the right to TERMINATE without prior confirmation.
- Without any obligation from Jenjang.com to provide notification, Jenjang.com reserves the right to suspend and/or discontinue service provision and without prejudice to other Jenjang.com rights if the service recipient does not immediately make bill payments when due.
- All orders are sent via Jenjang.com email. If you experience problems or questions when ordering services at Jenjang.com you can contact Jenjang Care at [email protected], Jenjang.com will try to respond to all questions as soon as possible.
- If you need a hardcopy or want delivery for invoice data, an administration fee of Rp.25,000 (twenty-five thousand rupiah) will be charged.
- For each transaction, a VAT fee of 11% of the transaction value will be charged (Effective Change April 1, 2022).
- In the case of service upgrades or upgrade service requests by service recipients, they are required to inform Jenjang.com at least 30 days before the service period expires via Jenjang.com email. After passing the 30 days before the due date, service recipients are required to renew the service.
- In the case of service downgrade, Jenjang.com cannot refund the remaining usage period of the previous package and service downgrade will only change service specifications and not for the service downgrade, renewal service fees will still follow the previous period renewal fees.
Cancellation Policy
- Cancellation or service termination requests can only be made by contacting customer service available on the Jenjang.com website to be directed to send a ticket through the client area regarding service cancellation to billing support. Based on this information, cancellation requests will not be processed and are not valid other than through CS application.
- Cancellation notification must be received no later than ten working days before the due date to avoid full charges for the next service period.
- Service recipients agree and will continue to pay bills according to the service period and if the service has not received a service cancellation confirmation email, Jenjang.com reserves the right to cancel unilaterally and automatically if the service recipient does not make payment.
- Jenjang.com reserves the right to cancel accounts at any time if violations are found on user accounts.
- It is your responsibility to ensure that the subscription you entered has been cancelled.
- Services cancelled or cancelled by users will automatically delete all data files (including backups) on the cancelled service.
- Billing will continue until you decide to stop or make a cancellation request.
- You have the right to decide to stop at any time. Jenjang.com does not provide refunds for services that have been used or have passed the refund policy period.
- If cancellation is made by Jenjang.com in connection with policy violations, there is no refund.
Auto Cancel Policy
The Auto Cancel system is a system that automatically cancels a payment bill. The Auto Cancel system applies if:
- The system will automatically cancel the invoice if a new Transaction is not paid until day 30 (counted from when the invoice is issued).
- The system will automatically cancel if the previously unpaid invoice (renewal bill not paid), is not paid until day 35 (counted from when the invoice is issued, on day 35 deletion or termination will be carried out.
- The system will cancel the payment process so users are advised to re-order on the Jenjang.com Transaction page.
Sales Invoice, Tax Invoice and Stamp Duty Policy
- Sales Invoice. "This Sales Invoice also serves as valid proof of payment"
- Information on Sales Invoice.
- This Sales Invoice is valid without being signed because it is issued electronically.
- This electronic Sales Invoice and/or its printout also serves as valid proof of payment.
- This electronic Sales Invoice and/or its printout is valid legal evidence in accordance with ITE Law Number 11 of 2008.
- Tax Invoice. In connection with PT. Jenjang Talenta Indonesia already having PKP status, it is advisable to apply for electronic Tax Invoice issuance where the Tax Invoice proof will be like the example below: "In accordance with applicable provisions, the Directorate General of Taxes stipulates that this Tax Invoice has been signed electronically so that a wet signature is not required on this Tax Invoice."
- Stamp Duty. Article 3 paragraph (1) of the Stamp Duty Law states: Stamp Duty is imposed on:
- Documents made as a tool to explain a civil event; and
- Documents used as evidence in court.
- Article 3 paragraph (2) letter g Documents stating amounts of money with a nominal value of more than Rp5,000,000.00 (five million rupiah) that:
- State receipt of money; or
- Stamp Duty is imposed 1 (one) time for each document and is subject to Stamp Duty at a fixed rate of Rp. 10,000
Stopping Service Use
If Customer fails to complete payment during the suspension period, the account will be automatically terminated.
If Customer decides to unsubscribe from Jenjang.com services, Customer cannot obtain a refund for services they are currently using.
Others
- Other matters not mentioned or regulated in these Terms and Conditions will be discussed further in brochures, books, leaflets, product catalogs, announcements/notifications, and/or other documents officially issued from time to time by PT. Jenjang Talenta Indonesia.
- The Subscription Contract is effective because it is signed by the CUSTOMER (or authorized person) and officials of PT. Jenjang Talenta Indonesia, and when Jenjang.com Services are Active.
- CUSTOMER fully understands, accepts, and complies with the Terms and Conditions when subscribing to Jenjang Services as stated in the subscription contract, including but not limited to other Jenjang services that may be developed by PT. Jenjang Talenta Indonesia from time to time.
- These terms and conditions may be adjusted according to service requirements.
- If there are problems or complaints regarding Jenjang.com Services, CUSTOMERS can contact us via Email: [email protected].
- All agreements, authorities, and/or rights you grant to us in these Terms and Conditions will not expire for any reason including for reasons referring to Articles 1813, 1814, and 1816 of the Civil Code as long as you are still using Jenjang.com Services.
- You hereby release us from all claims relating to the implementation of our actions based on the power, authority, and/or rights you grant to us under these Terms and Conditions and the exercise of our rights or authorities under these Terms and Conditions.
